Terms of Use

CHAPTER 1 General Provision
Article 1 (Purpose)
The purpose of this Terms of Use is to prescribe the matters related to the condition of use and the procedure of the services provided by the "K-BUILD" website(www.k-build.org), a B2B e-marketplace specialized in construction industry operated by MESSEESANG.

Article 2 (Notification and Revision)
1.This Terms of Use is displayed on the Internet site(www.k-build.org) where services as explained in Article 3(“Services”) are offered to “Members”(refers to the “Buyer” who obtains membership as described in Article 5 below and the “Exhibitor” who participate in premium online exhibition) and the other people who will use the services.
2.This Terms of Use prescribes general information on the Service Use Agreement made between MESSEESANG and Members. MESSEESANG may amend the Terms and notify the amended Terms to Members if necessary.
3.When MESSEESANG wishes to amend the Terms, MESSEESANG shall specify and notify the effective date of the amended Terms of Use and the cause of such amendment from seven to one day before the effective date.
4.By agreeing to this Terms of Use, Members shall comply with this Terms of Use and the Site Use Policy displayed to the Members by MESSEESANG.

Article 3 (Types of Services)
MESSEESANG offers the following Services:
1.Online exhibition: This service provides functions of online exhibition that allow download e-catalog, send inquiry and make a video meeting between Members through the Internet website (www.k-build.org) operated by MESSEESANG.
2.Other information services: These services indicate the Internet services such as information service and e-mail service provided for Members through the Internet website (www.k-build.org) except for sales purchase related services.

CHAPTER 2 Application and Termination
Article 4 (Principle of Use Agreement)
1.To make a service contract(“Use Agreement”) between the Buyer and MESSEESANG, the Buyer shall enter the user information into the prescribed form set by MESSEESANG and agree to this Terms of Use.
2.Only the Buyer who is permitted to use the Internet website (www.k-build.org) by the MESSEESANG manager is entitled to obtain membership and use Services to prevent any disputes that may arise in business relations between Members.

Article 5 (Application)
The applicant who wishes to use Services shall enter the following information in accordance with the membership application form provided by MESSEESANG online.

2.Optional Information : Name of Representative, Representative Phone Number, Representative E-mail Address, Website, Company Address, Main Products, Language, Meeting Program.

1.Essential Information : ID(Email), Password, Name, Job Position, Telephone Number, Mobile Number, Company name, Name of Representative, Business Type, Main Products, Representative Phone Number, Representative E-mail Address, Website, Company Address
2.Optional Information : Company Catalog, Company Introduction, Company Introduction Video, Preferred Video Meeting Time, Meeting Program.

Article 6 (Termination of Use Agreement)
1.Termination by Buyer
1)Buyer may terminate the Use Agreement by notifying his/her intention to terminate the Use Agreement to MESSEESANG. The Use Agreement is terminated when MESSEESANG identifies the intention of the termination.
2)A Buyer who terminates the Use Agreement may re-apply for K-BUILD after the termination in accordance with the application procedure specified in the Terms of Use.
2.Termination by MESSEESANG
1)MESSEESANG may terminate the Use Agreement without any notice in the following cases:
A Buyer violates the regulation set by MESSEESANG when the Member transacts business with another Member.
A Buyer has business relations or attempts to do business by violating this Terms of Use or the regulation set by K-BUILD.
A Buyer infringes the right of MESSEESANG or Members, defames their reputation, impairs their credit, or otherwise disadvantages them.
A Buyer disturbs or attempts to disturb K-BUILD.
A Buyer forces business transactions via negotiation, contract, and order even if the Member does not intend to trade in products.
A Buyer distributes contents against public morals or public order.
A Buyer defames other Member's reputation or disadvantages other Members.
A Buyer sends a large amount of information or spam to disturb the stable operation of Services.
A Buyer distributes computer virus programs that cause malfunction of information communication facilities or provide incorrect information.
A Buyer infringes intellectual property right of MESSEESANG, other Members, or the 3rd party. For examples:
A Buyer illegally uses the personal information such as user ID and password of other Members.
A Buyer posts obscene materials on the bulletin board or links to obscene sites.
A Buyer violates other agreements or related laws.
2)MESSEESANG may give an opportunity for the Buyer to express his/her opinion about the reason for termination before or after the termination.
3)The damages caused by the termination of the Use Agreement shall be a burden borne by the Buyer whose membership is expired by the termination.

CHAPTER 3 Protection and Provision of Personal Information
Article 7 (Collection of Personal Information)
1.MESSEESANG may collect the minimum information required for business negotiation. The information specified in Section 1 of Article 5 shall be essentially included, and other information shall be optional.
2.The personal information provided by MESSEESANG shall be used only for prompt and safe transactions, and shall not be used for other purposes. However, if the corresponding Member allows using the information for other purposes, the information may be used.

Article 8 (Offer and Share of Personal Information)
1.MESSEESANG may use personal information(except for the information displayed on the Internet website(www.k-build.org) such as user ID, name, etc.) in other online sites directly operated by MESSEESANG for the following purpose of the collection; use, seamless service, and service expansion, which are mentioned when the information is collected, and shall not use the information for other purposes. However, if the data subject allows use of his/her the information, the information may be used.
2.MESSEESANG may expose Buyer information in the K-BUILD(www.k-build.org) when the Buyer posts the ‘RFQ’ on K-BUILD(www.k-build.org).
3.MESSEESANG shall not provide personal information collected to a 3rd party without the permission of the data subject except in the following cases:
When law allows the use of the information of a Member or a 3rd party.
When the personal information is required for seamless transactions like registration as favorite products & exhibitors, sending inquiries, suggest video meetings, and Request For Quotations between Members.
When KOTRA and AKEI request MESSEESANG to submit the data.
4.Exhibitor ‘s phone number may be displayed on the product information screen.
5.The information of a Buyer is provided to the counterpart for product Q&A and negotiation.

Article 9 (Protection of Personal information)
1.Buyer always can view or change his/her information.
2.MESSEESANG shall make every effort to protect personal information, and a Member shall take proper measures to protect his/her information.

Article 10 (Storage of Personal information)
1.When the Use Agreement with a Buyer is terminated, MESSEESANG shall stop collecting, using, providing the corresponding personal information and destroy such information immediately. However, personal information shall be retained in the following cases:
MESSEESANG shall retain personal information for a certain time if it is considered to be remained.
MESSEESANG may retain some information(such as user ID, user name, phone number, address, and the information related to the termination of the Use Agreement and membership suspension) for a certain time period after the expiration or termination of Use Agreement to check if there is any cause to reject any re-application in the case where MESSEESANG terminates the Use Agreement or a Member’s membership is suspended.

Article 11 (Change and Management of Personal Information)
1.When the Buyer’s information is incorrect, Buyer may correct such information by him/herself or MESSEESANG may request to correct such information to the Buyer immediately. If the information is determined as incorrect information, MESSEESANG may suspend the Services until the information is properly changed.
2.Buyer shall be responsible for the damages caused by failing to correct his/her information where such information had changed. MESSEESANG shall not assume the responsibility for such damages.
3.Buyer is responsible for managing his/her personal information such as user ID and password.
4.Buyer shall not transfer or lend his/her user ID and password to a 3rd party.
5.If personal information is thieved or used by a 3rd party, the Buyer shall notify the information leakage to MESSEESANG immediately after it comes to his/her knowledge, and follow the actions taken by MESSEESANG to manage and protect the personal information.

CHAPTER 4 Disclaimer
Article 12 (Limitation of Liability)
1.To the maximum extent permitted by law, the Services provided by MESSEESANG on or through the Internet site(www.k-build.org) are provided "as is", "as available" and “with all faults”, and MESSEESANG hereby expressly disclaims any and all warranties, express or implied, including but not limited to, any warranties of condition, quality, durability, performance, accuracy, reliability, merchantability or fitness for a particular purpose. A such warranties, representations, conditions, and undertakings are hereby excluded.
2.To the maximum extent permitted by law, MESSEESANG makes no representations or warranties about the validity, accuracy, correctness, reliability, quality, stability, completeness or currentness of any information provided on or through the Internet website; MESSEESANG does not represent or warrant that the manufacture, importation, export, distribution, offer, display, purchase, sale and/or use of products or services offered or displayed on the sites does not violate any 3rd party rights; and MESSEESANG makes no representations or warranties of any kind concerning any product or service offered or displayed on the sites.
3.Any material downloaded or otherwise obtained through the Internet Site(www.k-build.org) or Services is done at each Member's sole discretion and risk and each Member is solely responsible for any damage to its own or to MESSEESANG’s computer system(s) or any loss of data that may result from the download of any such material. No advice or information, whether oral or written, obtained by any Member from MESSEESANG or through or from the Internet website (www.k-build.org) shall create any warranty not expressly stated herein.
4.The Internet website (www.k-build.org) may make available to “Services” or products provided by independent 3rd parties. No warranty or representation is made with regard to such services or products. In no event shall MESSEESANG be held liable for any such services or products.
5.Each Member hereby agrees to indemnify and save MESSEESANG, directors, officers and employees harmless, from any and all losses, claims, liabilities (including legal costs on a full indemnity basis) which may arise from such Member's access to or use of the Internet Site(www.k-build.org) or Services (including but not limited to the display of such Member's information on the Internet Site) or from Member’s breach of any of the terms and conditions of the Terms of Use. Each Member hereby further agrees to indemnify and save MESSEESANG, directors, officers and employees harmless, from any and all losses, damages, claims, liabilities (including legal costs on a full indemnity basis) which may arise from Member's breach of any representations and warranties made by Member to MESSEESANG.
6.Each Member hereby further agrees to indemnify and save MESSEESANG, directors, officers and employees harmless, from any and all losses, damages, claims, liabilities (including legal costs on a full indemnity basis) which may arise, directly or indirectly, as a result of any claims asserted by 3rd Party Rights claimants or other 3rd parties relating to products offered or displayed on the Internet Site. Each Member hereby further agrees that MESSEESANG is not responsible and shall have no liability to Members, for any material posted by others, including defamatory, offensive or illicit material and that the risk of damages from such material rests entirely with each Member. MESSEESANG reserves the right, at own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by Member, in which event Member shall cooperate with MESSEESANG in asserting any available defenses.
7.MESSEESANG shall not be liable for any special, direct, indirect, punitive, incidental or consequential damages or any damages whatsoever (including but not limited to damages for loss of profits or savings, business interruption, loss of information), whether in contract, negligence, tort, equity or otherwise or any other damages resulting from any of the following:
the use or the inability to use the Internet Site(www.k-build.org) or Services.
any defect in goods, samples, data, information or services purchased or obtained from a Member or any other 3rd party through the Internet Site(www.k-build.org) or Services.
violation of 3rd Party Rights or claims or demands that Member's manufacture, importation, exportation, distribution, offer, display, purchase, sale and/or use of products or services offered or displayed on the Internet website (www.k-build.org) or through the Services may violate or may be asserted to violate 3rd Party Rights; or claims by any party that they are entitled to defense or indemnification in relation to assertions of rights, demands or claims by 3rd Party Rights claimants.
unauthorized access by 3rd parties to data or private information of any Member.
acquisition of information not provided by MESSEESANG or on the Internet Site(www.k-build.org)
statements or conduct of any Member of the Internet Site(www.k-build.org) or Services; or;
any matters relating to the Internet Site(www.k-build.org) or Services, however arising, including negligence.

Article 13 (Force Majeure)
Under no circumstances shall MESSEESANG be held liable for any delay or failure or disruption of the content or the Services accessed or delivered through the Sites resulting directly or indirectly from acts of nature, forces or causes beyond MESSEESANG’s reasonable control, including without limitation, Internet failures, computer, telecommunications or any other equipment failures, electrical power failures, strikes, labor disputes, riots, insurrections, civil disturbances, shortages of labor or materials, fires, flood, storms, explosions, acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals or non-performance of 3rd parties.

CHAPTER 5 Miscellaneous
Article 14 (Related Law and Jurisdiction)
1.Any dispute which may arise between MESSEESANG and a member in relation to Services and this Terms of Use shall be governed by the law of Republic of Korea. All the law suits related with this dispute shall be exclusively brought in the courts of Republic of Korea, which has jurisdiction of the Code of Civil Procedure of Republic of Korea.
2.Any dispute which may arise between members in relation to transactions shall be governed by the law and court set forth in the agreement made during transaction, and MESSEESANG shall not assume the responsibility for the dispute.

Privacy Policy / GDPR Privacy Policy

All personal information handled by K-BUILD has been collected, stored and managed based on relevant Acts and Articles.
The Personal Information Protection Act provides general criteria for the handling of personal information, and K-BUILD will handle personal information, to be collected, stored and managed in accordance with the Article of the Act, legally and appropriately for proper performing of public services and for protecting user’s right and interest.
In addition, K-BUILD respects the interests of users such as access, correction, deletion and suspension of personal information as prescribed by relevant Acts and Articles. Users may request an administrative appeal in accordance with the Administrative Appeal Act in relation to the infringement of rights and interests in this Act.
K-BUILD formulates and discloses the following personal information management policy to protect the personal information and the rights and interests of owner of information according to Article 30 of the "Personal Information Protection Act" in order to seamlessly handle user's complaints related to personal information.

The Article 1 (Purpose of Personal Information Management)
K-BUILD manages personal information for following purpose. Management of personal information won’t be used for any purposes other than the following purposes and will take necessary measures such as obtaining separate consent, etc according to the Acticle 18 of Personal Information Protection Act in case the purpose of usage is altered.
K-BUILD, the purpose of the personal information file management to be registered and disclosed in accordance with the Article 32 of the Personal Information Protection Act is specified as follows.

The Article 2 (Personal Information Management and Retention Period)
K-BUILD manages and retains personal information within the period of retaining or using personal information in accordance with the article and the Act or during the period of using orretaining personal information consented from owner of information when to collect personal information.

The Article 3 (Providing Personal Information to a Third Party)
K-BUILD shall, in principle, manage the personal information of the owner of information within the scope specified for the purpose of collection and usage, and except for the following cases, will not manage beyond the scope of its original purpose or not provide to a third party without the prior consent of the owner of information.
1.The case to obtain separate consent from owner of information
2.The case special articles are prescribed in the Act and the Articles.
3.As the case where owner of information or legal representative is unable to give the declaration of his/her consent or is unable to obtain prior consent due to unknown address, the case clearly admitted to be necessary for the benefit of owner of information or third party's imminent life, body, property
4.As the case necessary for statistical writing and academic research purposes, the case to provide personal information in a form that can’t identify a specific individual
5.As the case the personal information is used for intended purposes other than the purpose or if not provided to a third party, the duties stipulated by other Act cannot be performed, the case to pass through deliberation and resolution of the protection committee
6.The case to be necessary to provide to foreign governments or international organizations for performing treaties or other international agreements
7.The case to be necessary for investigating crimes, and filing and maintaining the prosecution
8.The case to be necessary to perform the court’s trial
9.The case to be necessary to execute punishment as well as custody, probation

The Article 4 (Matters on Rights and Responsibilities of Owner of Information and Methods of the Usage)
The owner of information (the legal representative can exercise the right under 14 years of age) can exercise the right of personal information protection of following each subparagraph at any time.
1.Request to access personal information

3.Request to delete
4.Request to suspend management
The execution of right under Paragraph 1 may be made in writing, e-mail, or fax (FAX) after completing Attached Form 8 of the Enforcement Rules of the Personal Information Protection Act, and the institution will take measures without delay.
When owner of information has requested correction or deletion of personal information, it will not be use or provided that year personal information until the correction or deletion is completed.
The execution of right under Paragraph 1 may be done through the legal representative of owner of information or the agent, etc such as the person who has been delegated. In this case, he/she must submit a power of attorney according to Attached Form 11 of the Enforcement Rules of the Personal Information Protection Act.
The request of the personal information access and suspension of management of, the right of owner of information may be restricted by the Personal Information Protection Act Article 35 Paragraph 5, Article 37 Paragraph 2.
Requests for the correction and deletion of personal information cannot be requested to be deleted if the personal information is specified as to be collected object in the other Act and Articles.
We verify whether the person to request for access, correction, deletion, suspension, etc according to the owner of information’s right, is the person himself or a legitimate representative.

Requests for access, correction, deletion, and suspension of personal information management will be processed in the internal appointed procedure.

The Article 6 (Procedures and Methods of Personal Information Destruction)
K-BUILD will, in principle, destroy personal information without delay when the purpose of personal information management is achieved.
However, when it is necessary to preserve it in accordance with other Acts, this is not the case. The procedures, deadlines and methods of destruction are specified as follows.
A. Destruction procedure
Unnecessary personal information and personal information files are managed under the responsibilities of personal information manager according to the internal policy procedure as follows.

Destruction of personal information files
When the personal information file becomes unnecessary such as the purpose of personal information file management being achieved, abolition of service, or the end of the business, the personal information file is destroyed without delay from the date when personal information management is recognized as unnecessary.
B.How to destroy
1)Electronic forms of information use technological methods that cannot reproduce the records.
2)Personal information printed on paper is shredded by shredder or destroyed by incineration.
The Article 7 (Measures to Ensure the Safety of Personal Information)
K-BUILD, pursuant to Article 29 of the Personal Information Protection Acttt, takes the technical, administrative and physical measures necessary for ensuring safety as follows.
1.Minimization and training of personal information managers
We have designated and minimized the person in charge of personal information management and implemented measures to manage personal information.
2.Controlled and restricted access to personal information
We take necessary measures to control access to personal information through granting, modifying, and deleting access rights to the database system that manages personal information, and also control unauthorized access from outside by using an intrusion prevention system.
3.Storing access records
We keep and manage records (web logs, summary information, etc.) that have been connected to the personal information processing system for at least a year.
4.Encryption of personal information
The user’s personal information is encrypted and stored and managed. In addition, important data use separate security function such as using to be encrypted, etc when to store and transmit.
5.Security program installation and periodic inspection · update
K-BUILD installs and is periodically updated and inspected a security program to prevent personal information from being divulged or damaged by hacking or computer viruses.
6.Access control to unauthorized persons
The physical storage place of the personal information system that stored personal information is separately set up, and access control procedures are formulated and operated accordingly

The Article 10 (Personal Information Access Request)
The owner of information can request to access personal information pursuant to Article 35 of the Personal Information Protection Act to the following department. KOTRA will endeavor to promptly handle owner of information’s request to access personal information.

The Article 11 How to Relieve Infringement
The owner of information can inquire damage relief, consultation, and others about infringement of personal information to the following institutions.
(As the following institutions are separate from MESSEESANG, when you are not satisfied with MESSEESANG's own personal information complaints handling, damage relief results, or need further assistance, please contact them.)

The Article 12 (Matters on the Installation and Operation of Automatic Collection Device of Personal Information and Rejection thereof)
K-BUILD can use cookie which stores users information and detect them at any time (COOKIE, automatic collection device of personal information such as internet access information file, etc). A cookie, as a small amount of information that a server to be used to run an institution's website sends to a user's browser, is also stored on the user's computer's hard disk. When a user accesses a website, the institution’s computer can read the contents of the cookie on the user's browser and detect user’s additional information in your computer, and can provide the service without further input such as the name of the contact, and others. Cookies identify your computer but do not personally identify yourself. In addition, the user has the option of installing cookies. As a result, by that the user can install the options in the web browser, the user accept all cookies, or check each time when a cookie is saved, or refuse to save all cookies.
